About These Terms

These Shipping Terms apply whenever you use the Shipping feature within Gumtree Pay to send or receive an item ("Shipped Transaction").

These Shipping Terms form part of, and operate in addition to, Gumtree’s general website terms and conditions (“Terms of Use”), Gumtree’s Privacy Policy, the Gumtree Pay with Protected Shipping Policy for Buyers and the Gumtree Pay with Protected Shipping Policy for Sellers (collectively, the "Agreement").

In the event of any inconsistency between these Shipping Terms and the Terms of Use, these Shipping Terms prevail to the extent of the inconsistency in relation to Shipped Transactions. In the event of any inconsistency between these Shipping Terms and the Protected Shipping Policies, the relevant Protected Shipping Policy prevails.

Nothing in these Shipping Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, imposed by the Australian Consumer Law, (as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth) (“ACL”)) that cannot lawfully be excluded or restricted, including consumer guarantees under sections 54–62.

Definitions
Unless otherwise defined in these Shipping Terms, capitalised terms have the meaning given in the Terms of Use. The following additional definitions apply:

Tracking Information |
The tracking number, link, or status updates provided by the Approved Delivery Provider in relation to a Shipped Transaction. |

Scope and Application
-
These Shipping Terms apply to all Shipped Transactions on the Gumtree platform (“Platform”), where both:
-
the Buyer pays for the item using Gumtree Pay; and
-
the Seller selects “Shipping” as the delivery method via the Shipping feature within Gumtree Pay at the time of the transaction, enters the Tracked Information within the Shipping feature and ships the item using an Approved Delivery Provider.

These Shipping Terms do not apply to:
-
transactions where the Seller selects "Pickup" as the delivery method;
-
transactions where the item is shipped by the Seller outside the Shipping feature (including where the Seller uses an Approved Delivery Provider independently of the Shipping feature), even if Gumtree Pay is used;
-
transactions where payment is made outside Gumtree Pay (including PayPal, PayID, or bank transfer); or
-
items in excluded categories for which the Shipping feature has not been enabled.

Gumtree provides an introductory service as a passive conduit facilitating the relationship between Users through the Platform. Gumtree is not a party to any contractual relationship formed between Users in relation to any Listing or Exchange. Gumtree does not provide delivery services and is not the carrier. Shipping is arranged by the Seller using an Approved Delivery Provider.

Seller Obligations

Use of Approved Delivery Providers
-
The Seller must ship only through Approved Delivery Providers listed within the Shipping feature in Gumtree Pay, and must complete the steps set out in the Shipping feature.

Shipping through a different provider, or using a supported provider outside of the Shipping feature, will result in loss of all buyer and seller protections under the Protected Shipping Policies.
-
If the Seller chooses 'Pickup', the ‘Shipping cost’ line item will not be visible to the Buyer when they checkout with Gumtree Pay for that transaction. The Seller should ensure that the delivery method selected accurately reflects how the item will be delivered.

Tracking and Dispatch
-
The Seller must enter a valid tracking link on the Gumtree platform within 3 days of payment.
-
Failure to provide valid tracking within 3 days may result in automatic cancellation of the order and a full refund to the Buyer.
-
The Seller will be notified by Gumtree if the order is approaching the cancellation deadline.
-
When entering a tracking ID, the Seller must confirm that the tracking ID relates to that specific order and accurately reflects the item shipped to the Buyer.
-
If an item is not delivered, the Seller must comply with Gumtree's instructions, otherwise Gumtree may facilitate a refund to the Buyer.

Listing Accuracy and Photographs
-
The Seller must always create accurate listings, ensuring the listing description and photographs match the item exactly. At least one photograph of the item must be included in a listing where the Seller has enabled the Shipping feature within Gumtree Pay.

Listing photographs will be used as the primary evidence of the item's described condition in the event of a dispute. The Seller must ensure photographs are clear, accurate, and show all relevant features and any known defects. Seller eligibility for protection may be reduced or removed if no photographs were included in the listing at the time of sale.

Packaging
-
The Seller must package items appropriately for transit, having regard to the nature and fragility of the item. Damage caused by inadequate packaging is the Seller's responsibility.

Identity and Bank Verification (KYC)
-
Before a Seller can receive any payout from a Shipped Transaction, the Seller must successfully complete identity and bank verification (“Know Your Customer”, or "KYC") through Gumtree's third party payments partner, Adyen, or such other replacement Gumtree may appoint from time to time.

In accordance with clause 13(h)(B) of the Terms of Use, Sellers must provide all information requested (including all KYC information) within 30 days of being prompted to do so. We strongly encourage Sellers to complete this process before sending their first payment request.

If KYC is not completed:
-
funds cannot be released to the Seller; and
-
Gumtree will hold the Seller's funds pending completion of KYC in accordance with the Terms of Use and applicable law.

Where KYC has not been completed and the Buyer has already received the item, funds will not be refunded to the Buyer solely on account of the Seller's KYC non-completion. The funds will be held by Gumtree pending the Seller's completion of KYC or dealt with in accordance with applicable unclaimed funds processes.

The Seller's personal information collected as part of the KYC process will be handled by Adyen in accordance with Gumtree's Privacy Policy and to comply with obligations under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth). Buyer Obligations

Delivery Address
-
The Buyer must ensure the delivery address is entered correctly. If the Buyer enters an incorrect delivery address and the Seller has already shipped the item to that address with valid tracking, the Buyer is responsible for contacting the delivery provider directly to redirect the parcel. Gumtree cannot guarantee a refund in these circumstances.

Inspection Period
-
Once the shipping provider marks the item as "delivered," the Buyer has 3 days to inspect it and confirm it has arrived and is as described.
-
If the Buyer does not raise a dispute within this 3-day period, the Seller's payout will be automatically released, and the Buyer will lose the right to claim under the Protected Shipping Policy.

If the Buyer needs more time, the Buyer must contact Gumtree Customer Support before the 3-day window expires to request an extension. Extensions are granted at Gumtree's discretion.

Cooperation
-
The Buyer must cooperate reasonably with Gumtree's investigation process by:
-
providing clear photographs of the item as received within the timeframe requested by Gumtree;
-
responding to requests for information within the timeframe requested by Gumtree;
-
retaining the item in the condition it arrived until the dispute is resolved; and
-
returning, if required by Gumtree, the item in the same condition it arrived.

If the Buyer fails to cooperate reasonably with Gumtree's investigation process, Gumtree may, in its discretion, close the dispute and release the Seller's payout.

Payment Method
The Buyer will not be eligible for protection if they pay via a direct money transfer outside of the Gumtree app or website, including PayPal, PayID or a bank transfer.

Delivery, Title, and Risk of Loss
-
Title
-
Title to the goods passes to the Buyer on payment of the Exchange Fee.
-
Risk — Seller to Buyer (Outbound Shipping)
-
The Seller is responsible for the item from the time of dispatch until delivery is confirmed by the Buyer as being as described in the listing.
-
For Shipped Transactions, risk of loss or damage to the item during transit remains with the Seller until the Buyer confirms the item is as described in the listing.
-
Gumtree Pay with Protected Shipping does not cover loss of, or damage to, items during transit. If the item is lost or damaged by the delivery provider and the Seller has not arranged adequate shipping insurance, the Seller bears the full financial risk.

Risk — Buyer to Seller (Return Shipping)
-
Where a Buyer is required to return an item, the Buyer is responsible for the condition of the item during return transit. Risk of loss or damage to the item during return transit is borne by the Buyer.

The Buyer must use a tracked shipping method when returning items and must provide Gumtree with a valid tracking number.

Insurance
-
Gumtree strongly recommends that Sellers arrange insurance covering the full value of their item before shipping.
-
Buyers who are returning items are strongly encouraged to take up any offer of insurance available from the delivery provider they choose.
-
Gumtree does not provide, arrange, or endorse any specific insurance product. Any insurance is a matter between the relevant party and the insurer or delivery provider.

Tracking Information
-
Tracking Information is provided by the Approved Delivery Provider. Gumtree does not independently verify Tracking Information and is not responsible for its accuracy, timeliness, or completeness.

Tracking updates may be delayed or incomplete due to circumstances outside Gumtree's control. Gumtree does not provide delivery services and is not the carrier.

In the event of a discrepancy between Tracking Information and the actual delivery status, Gumtree may rely on the information available from the Approved Delivery Provider when making any determination under the Protected Shipping Policy.

Disputes and Returns
-
The dispute resolution process for Shipped Transactions is set out in the relevant Protected Shipping Policy:
-
Buyers: Gumtree Pay with Protected Shipping Policy for Buyers; and
-
Sellers: Gumtree Pay with Protected Shipping Policy for Sellers.
-

Where an item is significantly not as described or has not arrived, Buyers must raise a dispute with Gumtree first and within the Inspection Period to pause the release of the Seller's payout.
-
Protected Shipping does not apply if the Buyer changes their mind about an item. In those cases, the Buyer should contact the Seller directly to discuss options.
-
Buyers must not seek recovery through more than one channel simultaneously. Protected Shipping does not apply if the Buyer has already initiated a chargeback, PayPal dispute, or any other external payment dispute in relation to the same transaction.

Where a return is approved by Gumtree, the Buyer must dispatch the return within 3 days of that approval. If the Buyer fails to dispatch within this period, the dispute will be closed and the Seller's payout will be released.

Once the return is marked as delivered to the Seller by the return delivery provider, the Seller has 3 days to confirm:
-
that the item has been received in its original state; or
-
raise a condition issue with Gumtree about the returned item, including photographic evidence.

If the Seller does not confirm receipt or raise a condition issue within 3 days of the return being marked as delivered, Gumtree will treat the Seller's silence as confirmation that the item was received in its original state and will proceed to issue a refund to the Buyer.

Gumtree reserves the right to refund the Buyer without requiring the item to be returned as set out in the Protected Shipping Policies (i.e. if the Seller has clearly sent a damaged or unusable item).

$1,000 Transaction Value Limit for Buyers and Sellers
-
Gumtree Pay with Protected Shipping applies to transactions with a total value of AUD $1,000 or less.
-
For transactions above AUD $1,000:
-
the buyer protection cover set out in the Gumtree Pay with Protected Shipping Policy for Buyers does not apply. Gumtree will use its best endeavours to facilitate a refund to the Buyer but cannot guarantee that the Buyer will receive a refund if something is not right with their item. For the avoidance of doubt, the Buyer must still comply with all of its obligations under these Shipping Terms and the Protected Shipping Policy for Buyers regardless of the transaction value.

the seller protection cover set out in the Gumtree Pay with Protected Shipping Policy for Sellers does not apply. Gumtree will use its best endeavours to assist the Seller in resolving any dispute, but cannot guarantee any particular outcome. For the avoidance of doubt, the Seller must still comply with all of its obligations under these Shipping Terms and the Protected Shipping Policy for Sellers regardless of the transaction value.

Regardless of the transaction value, both Buyers and Sellers may retain rights and obligations under the ACL, including where the Seller is acting in trade or commerce. The transaction value limit in this clause does not affect any rights or remedies available under the ACL.

Gumtree will notify both the Buyer and the Seller at or before the point of transaction where a transaction exceeds the AUD $1,000 threshold, so that both parties are aware that the Protected Shipping Policies do not apply to that transaction.

Excluded Categories
-
The Shipping feature is only available for items listed in categories for which it has been enabled by Gumtree. Gumtree Pay with Protected Shipping is not available for items in categories that have not been enabled (including those categories marked as excluded as set out in the respective Protected Shipping Policies).

Gumtree may update the list of excluded categories at any time.

Personal Information and Privacy
-
Gumtree handles personal information in accordance with its Privacy Policy and applicable privacy laws, including the Privacy Act 1988 (Cth).

When using the Shipping feature, the Buyer's name and delivery address will be collected by Gumtree and shared with:
-
the Seller, for the purpose of shipping the item; and
-
the Approved Delivery Provider, for the purpose of delivery and tracking.
-

The Seller must use the Buyer's name and delivery address solely for the purpose of fulfilling the Shipped Transaction. The Seller must not use or disclose this information for any other purpose.
-
When shipping returns, the Seller’s name and delivery address may be collected by Gumtree and shared with:
-
the Buyer, for the purpose of returning the item; and
-
the chosen return shipping provider, for the purpose of delivery and tracking.
-

The Buyer must use the Seller's name and delivery address solely for the purpose of shipping the returned item to the Seller (if applicable). The Buyer must not use or disclose this information for any other purpose.
-
-
Gumtree's Role and Limitations
-
Gumtree facilitates the Shipping feature as part of its platform services. Gumtree is not:
-
a party to any contract of carriage between the Seller and the Approved Delivery Provider;
-
responsible for the acts or omissions of any Approved Delivery Provider;
-
a carrier, freight forwarder, or postal operator; or
-
an insurer of any item.

Claims for loss of or damage to items in transit must be made against the carrier by the Seller. To the maximum extent permitted by applicable law, Gumtree accepts no liability for any loss or damage to any Goods during delivery.

Gumtree Pay with Protected Shipping is not an insurance policy, a warranty, or a guarantee. Gumtree reserves the right to change, suspend, or discontinue the programme at any time, for any reason.

Gumtree will exercise its discretion under these Shipping Terms and the Protected Shipping Policies reasonably and in good faith, having regard to the evidence provided by both parties. Gumtree will provide reasons for any adverse determination where reasonably practicable.

Liability
-
Gumtree's liability in connection with these Shipping Terms is limited in accordance with clause 20 of the Terms of Use.

To the maximum extent permitted by law, Gumtree is not liable for:
-
any loss, damage, or delay caused by an Approved Delivery Provider;
-
any loss arising from the Buyer providing an incorrect delivery address;
-
any loss arising from the Seller's failure to arrange adequate insurance;
-
any indirect, consequential, or special loss arising from or in connection with a Shipped Transaction; or
-
any failure or delay in Tracking Information provided by third parties.

Nothing in this clause excludes or limits Gumtree's liability to the extent that it cannot be excluded or limited under the ACL or any other applicable law.

Changes to These Terms
-
To the extent permitted by law, Gumtree reserves the right to modify, suspend, or terminate the Shipping feature, any cover offered under a Protected Shipping Policy or these Shipping Terms from time to time but any such change will operate prospectively only (that is, it will not affect transactions already in progress at the time notice is given). Where Gumtree makes changes to these Shipping Terms that are adverse to you, Gumtree will provide you with at least 30 days' written notice before those changes take effect in relation to future transactions.

You are free to stop using the Platform if you do not agree to the updated terms. If you continue to use the Platform after such notice is given, you will be taken to have agreed to these Shipping Terms as updated.

Governing Law and Jurisdiction
These terms are governed by the laws of New South Wales, Australia. Each party irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales.

Severability
If any provision of these Shipping Terms is unenforceable at law, that provision is to be severed to the narrowest extent possible to overcome the enforceability issue, and the remaining provisions continue to apply with full force and effect.
