In this Privacy Policy (Policy) "uWorkin", "we," or "us" means uWorkin Pty Ltd ACN 139 962 664. We respect your privacy and are committed to the good practice of management and protection of personal information. This Policy describes how we manage, use and protect your personal Information. By using uWorkin, you consent to us dealing with your personal information in accordance with the terms of this Policy.

About Us
uWorkin is a technology and platform to facilitate the interaction between individuals and a wide variety of potential employer groups through the creation of specific talent communities which include but are not limited to community, local government, industry associations, educational institutions and infrastructure development projects (Talent Communities).


uWorkin allows for different Talent Communities to be created and managed by individuals approved by uWorkin (Talent Community Owner). Following the creation of a specific Talent Community, the uWorkin platform facilitates the creation of accounts for both individuals seeking employment opportunities within a Talent Community to search and apply for jobs (Talent Community Job Seekers) and for employers to either post job adverts or search for potential employees (Talent Community Employers).


Our purpose is to facilitate both the creation of specific Talent Communities and connect Talent Community Job Seekers with Talent Community Employers through the uWorkin platform (the Services).

 

Your Privacy and Information is Important
uWorkin takes your privacy and collection of personal information seriously. The purpose of this Policy is to provide you with details about how we collect, store, use and disclose your personal information in compliance with our obligations under applicable privacy legislation.

 

Information We Collect

Information from Talent Community Owners, Employees and Employers
If you are a Talent Community Owner, Talent Community Job Seeker or Talent Community Employer seeking use of the Services we may collect:

  1. your name, names of employees resume/CV, social medial profile, username or other identifier, business name, ACN and ABN; (Identity Data);

  2. your phone number, your employee phone numbers, email addresses (including employee email addresses) billing and postal address (Contact Data);

  3. your internet protocol (IP) address, your login data, access dates and times, browser type and version, device information, cookie data, time zone setting and location, browser plug-in types and versions, operating system and platform and other technology on the devices you use to access uWorkin (Technical Data);

  4. your username and password, preferences, user-generated content, job searches, candidate searches, applications, feedback and survey responses (Profile Data); and

  5. how you use uWorkin and other products and services including AirCV (Usage Data); and

  6. preferences for receiving marketing from us, third parties and communication preferences (Marketing Data), (collectively Personal Information).

Information obtained from third-party sources.
If you have created a uWorkin account by using a third-party site including but not limited to Facebook, Google or Apple (TPS), we will extract the publicly available Personal Information that you have provided to the TPS (such as your name and email address that you make publicly available via the TPS) and use the Personal Information to create your account. The specific information that we extract may depend on the privacy settings you have with the TPS.

How Your Personal Information is Collected

Direct Interaction uWorkin may collect, use, store or transfer different kinds of Personal Information about you that is provided to us either through registering and accessing uWorkin as either a Talent Community Owner, Talent Community Job Seeker and/or Talent Community Employer. Automated Technologies and Interactions
As you interact with uWorkin, we may automatically collect Technical and Usage Data about your device, browsing actions and patterns. We collect this information by using cookies, server logs and other similar technologies. We may also receive Technical Data and Usage Data about you if you visit other websites employing our cookies and other technology. For more information regarding this, please refer to Section 8 “Cookies and Other Technology” below.

 

From TPS
If you have used a TPS to create an account, we may receive Personal Information from this TPS. For more information about TPS and social media features please refer to Section 9 “Links to TPS and Social Media Features.”

Why we collect, hold and use your Personal Information
We will collect, hold and use Personal Information for the primary purpose to provide the Services including tasks which are supplementary to this including:

 

  • account creation and management;

  • newsletter and marketing;

  • uWorkin platform administration and management;

  • on-line browsing of the uWorkin platform;

  • to provide user generated content;

  • any inquiries and or messaging; and

  • to facilitate interactions and messaging between Talent Community Owners, Talent Community Job Seekers and Talent Community Employers.

 

We may also collect, use and share aggregated data such as statistical or demographic data. Aggregated data may be derived from your Personal Information but is not considered Personal Information since it does not directly or indirectly reveal your identity.

 

Who has control and access of Personal Information?
You either as a Talent Community Owner, Talent Community Job Seeker or Talent Community Employer (collectively User Accounts) have access to your own Personal Information.

 

Within a Talent Community, the designated Talent Community Owner has the highest level of privilege and may appoint and approve administrator rights of their staff members. Talent Community Owners may also access the specific Talent Community data and analytics.
 

Talent Community Employers can request access to search AirCV’s which can be granted by Talent Community Administrators. The Employer will be able to search the AirCV profile of Talent Community Job Seekers to match against live jobs. Talent Community Employers cannot access personal contact information of the Talent Community Job Seeker, but can communicate with the Talent Community Job Seeker through the uWorkin platform.

 

Who we share your Personal Information with
To provide the Services, it may be necessary to disclose your Personal Information to a variety of parties in the course of our business including:

 

our affiliates to help us operate and improve our business;

service providers that we use to support our business and help provide our services to you, including, but not limited to, third parties that host our websites, assist us to verify your identity, perform website and platform maintenance, risk assessments, and security, perform data and web analytics, provide databases, IT services, customer service, communication services, and email services;

our professional advisers, such as accountants, lawyers, auditors and insurers;

third party providers of research services, payment processing service, data processing services and entities that support the security and block suspicious behaviour;

Third parties when you have expressly consented to the disclosure of your Personal Information; and

if required or authorised by law, regulatory bodies, government agencies and authorities, tribunals, law enforcement bodies and courts.

 

How we store and secure Personal Information
We use appropriate technical and organizational measures to protect your Personal Information and have put in place procedures to deal with any suspected Personal Data breach.

The safety and security of your Personal Information also depends on you. You are responsible for keeping your password to your uWorkin account confidential. We ask you not to share your login or account credentials with anyone and keep your account information secure. If you believe that your access credentials or Personal Information have been compromised, please contact us immediately.

 

Cookies and Other Technology
Cookies and other technologies may be used by us or by third parties when you visit or access the uWorkin website. In some cases, we may collect Personal Information from cookies.
A cookie is a small text file that uWorkin or a third party may place on your device to store information and analyse trends, administer the uWorkin technology and platform and collect Technical Data about our users.
Any Technical Data collected from cookies and other technologies is used in managing the uWorkin technology and platform and improving its functionality and reliability, as well as to assist us to better target advertising, report statistics, analyse trends, administer our services, diagnose any errors so that we can provide you with the best Service.

 

Links to TPS and Social Media Features
The uWorkin platform or website may from time to time, contain links to third-party services such as websites, locations, platforms, applications or services operated by third parties. If you follow a link to or otherwise access any of these third-party services, these third-party services may use their own cookies or other technology to independently collect data from you. Please note that these third-party services have their own privacy policies and we do not accept any responsibility or liability for these parties’ policies or practices. Please check these policies before you share any Personal Information with these third-party services.


Our platform may also offer you the opportunity to use your Google, Apple or Facebook account or other social media login when interacting with our website. If you do so, please be aware that you may be sharing your Personal Information. The Personal Information that is shared will depend on your specific Facebook or social media platform settings. Please visit Google, Apple, Facebook or other relevant social media platforms and review their privacy policy to understand how your Personal Information is shared and used in this context.
Google, Apple, Facebook and other social media features may also collect your IP address, which page you are visiting on the uWorkin platform, and may set a cookie or other technology to enable the applicable social media feature to function properly. Your interactions with these features are governed by the privacy policy of Facebook or the other company providing such features.

 

Overseas Recipients
The Privacy Act 1988 (Cth) (Act) and corresponding Australian Privacy Principles (APPs) require relevant Australian entities to ensure that, before disclosing personal information overseas, reasonable steps are taken to ensure that overseas recipients do not breach the Act or the APPs (APP 8.1). It is not always possible to ensure that overseas recipients will comply. We do not take any responsibility for the actions of overseas third-party recipients of personal information.


By agreeing to this Policy, you are agreeing that your personal information may be disclosed overseas, and that APP 8.1 will not apply to that disclosure. This means that you will not have recourse against us under the Act if an overseas recipient of your Personal Information breaches the APPs.

 

Deleting, accessing, updating and correcting Information

Deleting your uWorkin user account:
Any user with a uWorkin user account can delete their own account within the Member Dashboard > My Profile tab.
Any user with a uWorkin user account can revoke their access to a specific Talent Community but maintain their uWorkin user account to access other Talent Communities on the uWorkin platform, within the Member Dashboard > My Profile tab.

Request assistance to delete, access, update and correct Information:
You can contact us and ask to access, update, correct and delete your Personal Information held by us. For more detailed information, you may need to fill out a request form on our website https://www.uworkin.com/p/contactus/.
We can be contacted by email at info@uworkin.com to request access to, delete or correct the Personal Information held by us. In accordance with applicable legislation, there may be a fee for our work-effort in providing access to the detailed personal information we hold about individuals from our internal records.

 

If a Talent Community is closed, user accounts and user data may be removed for all users not associated with any other Talent Community platforms.

 

Complaints
If you think we have breached the Act, any APPs or you wish to make a complaint about the way we have handled your personal information, you can contact us via email at info@uworkin.com or submit a form https://www.uworkin.com/p/contactus/. Please include your name, email address and/or phone number and clearly describe your complaint.
Privacy enquiries and complaints will be considered by an appropriate person within our organisation, and we will respond to enquiries and deal with any complaints promptly and fairly, in accordance with our legal obligations.
