Provider: Gumtree AU Pty Ltd (ABN 33 616 996 840) (referred to as “Gumtree”, "we", "us", or "our")

1. Acceptance

• Acceptance: By redeeming, attempting to redeem, or otherwise using a discount code, you confirm that you have read, understood, and agree to be bound by these Terms & Conditions for Discount Code Use (“Discount Code Terms”). If you do not agree to these terms, you should not redeem or attempt to use a discount code.

• Incorporation: These Discount Code Terms form part of, and operate in addition to, Gumtree Australia’s general website terms and conditions (“General Terms”).

• Precedence: If there is any inconsistency between the Discount Code Terms and the General Terms, the Discount Code Terms prevail to the extent of that inconsistency, but only in relation to the relevant Discount Code and its redemption. 

• ACL: Nothing in these Discount Code Terms excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, imposed by the Australian Consumer Law, (as set out in Schedule 2 to the Competition and Consumer Act 2010 (Cth) (“ACL”)) that cannot lawfully be excluded or restricted.

2. The Offer

• Redemption: To apply a discount code (“Discount Code”), enter it exactly as shown at the checkout page before completing your purchase of a listing or feature.

• One-Time Use: Unless otherwise stated, each Discount Code can only be used once per customer and cannot be combined with any other promotional offers or discounts.

• Retrospective Use: Discount Codes must be applied at the time of purchase. We cannot apply a discount to a transaction that has already been processed.

• Specific Discount Code Terms: The key terms of your Discount Code (including the applicable percentage or fixed dollar discount, any usage cap, and the expiry date) will be communicated to you at the time the Discount Code is issued (for example, via the promotional email, SMS, push notification or in-product banner through which the Discount Code is delivered). You should retain this communication as a record of those specific terms.

3. Eligibility & Usage Limits

• Private Sellers only: Unless a Discount Code states otherwise, Discount Codes are available to Private Sellers only. A Private Seller is a user who: 

  • does not hold a business subscription (or other subscription-based seller plan offered by Gumtree from time to time); and 

  • lists items for sale via the standard “Post an Ad” flow.

• Excluded sellers: Discount Codes are not available to business sellers or users who hold a current business subscription with Gumtree. If a Discount Code is redeemed by an ineligible user, Gumtree reserves the right to void the transaction and, where a charge has been processed, issue a refund of the amount paid less the discount applied, or such other remedy as Gumtree determines is reasonable in the circumstances.

• Gumtree discretion: Gumtree may determine whether you are eligible to redeem a Discount Code, acting reasonably and by reference to your account configuration and the way you access posting and checkout.

• Account Specificity: Some Discount Codes are created specifically for your Gumtree user account ("Personalised Codes"). Personalised Codes are linked to your unique user account ID, are non-transferable, and will only function when you are logged into the account to which the Discount Code was issued. Sharing or distributing a Personalised Code to any other person is a misuse of the Discount Code and may result in the Discount Code being voided (see Clause 5 below).

• General Offers: Other Discount Codes may be open to eligible sellers generally but may be subject to a global "total use" limit. Once this limit is reached, the Discount Code will no longer be valid.

• Usage Caps: Each Discount Code may have a maximum number of redemptions per eligible seller (e.g., "Valid for 3 uses"). Once you reach this limit, the Discount Code will no longer be available for your account.

4. Validity & Time Periods

• Promotion Period: Each Discount Code is valid only from the Start Date to the End Date specified in the promotional communication accompanying the Discount Code ("Promotion Period"). A Discount Code entered after the end date of the Promotion Period will not be accepted at checkout, even if the listing or checkout session was initiated within the Promotion Period.

• Time Zone: All dates and times are governed by the local time in New South Wales, Australia (AEST/AEDT).

• Issuance Windows: For certain personalised offers, the Discount Code may expire a specific number of days after it was sent to you, which may be sooner than the general campaign end date.

5. Limitations & Exclusions

• Minimum Spend: If a minimum spend is required, it will be stated in the promotional communication for that Discount Code. The minimum spend is calculated by reference it applies to the total payable amount for a single checkout transaction associated with a single listing (before the discount is applied). A checkout may include mandatory insertion fees (for example, pets), mandatory package fees (for example, cars, caravans or jobs), optional bundles or packages, and optional upsell features selected for that listing. Unless the relevant Discount Code expressly states otherwise, the discount does not carry over across multiple listings or separate checkouts.

• What You Can Pay For at Checkout: When a Private Seller posts an item for sale, the following amounts may be payable at checkout and may (subject to the terms of the relevant Discount Code) be eligible for a discount:

  • insertion fees (applicable to listings in the Pets category);

  • package or listing fees (applicable to Cars, Caravans, and certain Jobs listings);

  • bundle or package fees, where a seller elects to purchase a bundle for a listing that does not attract a mandatory fee (including packages that include upsell features or enhanced visibility in search results); and

  • individual upsell features purchased on a standalone basis (for example, Highlighted Ad or Website Link inclusion).

• Eligible categories, fees & features: A Discount Code may be limited to particular categories (e.g., "Home & Garden"), or features (e.g., “Highlight”, "Urgent" or "Listing Fee"). The applicable restrictions will be stated in the promotional communication for that Discount Code. Where a Discount Code is restricted to a specific category or feature, it cannot be applied to any other category or feature in the same checkout session.

• No Cash Value: Discount Codes have no monetary value, are not redeemable for cash or credit, and cannot be transferred or exchanged.

6. Errors, Misuse and Technical Issues

• Unintended Stacking: Discount Codes cannot be combined or "stacked" with other Discount Codes or promotional discounts in the same checkout session unless expressly permitted in the promotional communication for the relevant Discount Code. Where multiple Discount Codes are entered in a single checkout session and stacking is not permitted, Gumtree reserves the right to apply only one Discount Code (at Gumtree's discretion) and to disregard the remainder.

• System Errors: If a Discount Code is applied or redeemed as a result of a technical error, system malfunction, or an error in the promotional communication (for example, an incorrect discount amount), Gumtree reserves the right to:

  • void the relevant transaction and refund to you the amount you actually paid; or

  • where it is reasonably practicable to do so, honour the discount at the correct level and issue a revised tax invoice.

Gumtree will notify you if it intends to void a transaction under this clause.

• Misuse of Personalised Discount Codes: A Personalised Code is issued exclusively for use by the account holder to whose account it is assigned. You must not share, transfer, sell, publish, or otherwise distribute a Personalised Code. If Gumtree determines, acting reasonably, that a Personalised Code has been used by or transferred to a person other than the intended account holder, Gumtree may:

  • void any transaction in which the misused Discount Code was applied;

  • suspend or terminate the Discount Code; and/or

  • take such further steps as are reasonably necessary to address the misuse, including suspension of the relevant account(s) in accordance with Gumtree's General Terms and Conditions.

• Fraudulent or Abusive Conduct: Gumtree reserves the right to void any Discount Code, reverse any discount applied, and take appropriate action (including account suspension) where it reasonably suspects that a Discount Code has been obtained or used fraudulently, or in a manner that is designed to circumvent the intended purpose of the Discount Code.

• No Liability for System Downtime: Gumtree does not warrant that checkout or Discount Code redemption systems will be available without interruption. Gumtree is not liable for any loss or damage arising from an inability to redeem a Discount Code due to system unavailability, provided that Gumtree uses reasonable endeavours to restore system availability in a timely manner.

7. Discount Application

• Percentage vs. Fixed Amount: Discounts are applied as either a percentage or a fixed dollar amount.

• The "Zero" Rule: A discount cannot result in a negative balance. If a fixed dollar Discount Code (e.g., $10) is applied to a feature costing less (e.g., $8), the feature price will become $0.00, and the remaining balance is forfeited.

8. Refunds & Cancellations

• Refund Amount: If you are eligible for a refund on a discounted purchase, you will only be refunded the actual amount paid at checkout.

• Discount Code Re-use: Once a Discount Code is used, it is considered spent. If you cancel your listing or request a refund, the Discount Code will not be re-issued or reactivated.

9. Governing Law & Changes

• Governing Law: These terms are governed by the laws of New South Wales, Australia. Each party irrevocably submits to the non-exclusive jurisdiction of the courts of New South Wales.

• Changes, suspension and withdrawal: To the extent permitted by law, Gumtree reserves the right to modify, suspend, or terminate  a Discount Code (or these terms) from time to time but any such change will operate prospectively only (that is, it will not affect a discount validly applied to a completed checkout), except where Gumtree reasonably determines the discount was applied as a result of fraud, misuse, breach of these terms or technical/system error. Code-specific details (including discount amount, expiry, usage limits and eligibility restrictions) will be communicated at the time the Discount Code is issued, at checkout, or both. 

10. Privacy and Marketing Communications

• Privacy: Gumtree handles personal information in accordance with its Privacy Policy, available here and applicable privacy laws.

• Promotional channels and preferences: Discount Codes may be promoted or delivered via email, SMS, push notifications and in-product messaging. You can manage your marketing preferences in accordance with applicable laws (including the Spam Act 2003 (Cth)).

• Code assignment: Discount Codes may be assigned to your Gumtree account and generally do not require you to provide personal information beyond the information already associated with your seller account.

11. Campaign-Specific Terms

Each Discount Code may be subject to additional campaign-specific conditions disclosed with the Discount Code. If there is any inconsistency between those campaign-specific conditions and these terms, the campaign-specific conditions prevail for that Discount Code only (to the extent of the inconsistency).
