All Listings must comply with the Posting Policies and Gumtree reserves the right to not publish or remove at any time any Listing which violates the Posting Policies.
-
Any User may, in its absolute discretion, engage with any Listing, which is not a commitment to proceed with the offer in the Listing (until all of the criteria in clause (f) are satisfied).

-
Depending on the nature of the Listing, additional terms set out in the following clauses will apply.
7. SPECIFIC TERMS FOR SERVICES
-
If a Listing offers the performance of Services, this clause 7 applies to those Services.
-
For the avoidance of doubt, Services are where a Seller offers to perform Services for a Buyer in the “Services for Hire” category and/or the Seller sets the price, which is legally a different scenario to an Employer looking for Employees to perform a Job under clause 8.
-
The Seller represents and warrants that it has the appropriate skills, qualifications, and experience to perform the Services described in the Listing and otherwise communicated to the Buyer.
-
If a Seller performs Services, it must ensure that the Services:
-
are of an acceptable standard with regard to the nature of the Services as described by the Seller;
-
are performed with due diligence and skill; and
-
meet all representations made to the Buyer during Exchange, including when such Services will be delivered.
-
-
The Buyer acknowledges that it is responsible for reading the Services description and warrants that it has satisfied itself that the Services as described will meet the Buyer’s requirements prior to agreeing to Exchange.
-
The Buyer is responsible for ensuring the location for performance of the Services is made accessible to the Seller on the agreed date, at the agreed time, for performance.
-
The Seller is responsible for ensuring compliance with work health and safety procedures when performing the Services, including ensuring they hold Employees’ compensation insurance, professional indemnity and Employee’s compensation insurance as applicable to the Services.
-
Buyers are strongly encouraged to hold home and contents insurance and public liability insurance if applicable to the Services.
-
If a Listing is for a Job, this clause 8 applies.
-
For the avoidance of doubt, Jobs are where an Employer initiates the need for an Employee, and the terms of engagement are set by the person needing, not performing, the services.
-
If you use the Jobs specific functionality from our technology partner (Gumtree Jobs Talent Community), you agree to:
Nothing in those terms, or the act of accessing the Gumtree Jobs Talent Community through the use of a technology partner, limits or otherwise effects your responsibility to comply with all Employment Laws at all times.
-
The Employer is responsible for ensuring compliance at all times with the Posting Policies, which include strict guidelines for adherence to the Employment Laws.
-
Without limiting or otherwise effecting clause 8(c), the Employer must ensure that the Exchange Fee in clause 13(d) is compliant with the Employment Laws, Section 536AA of Fair Work Act 2009 (Cth) and does not violate minimum entitlements under the Employment Laws, which includes (but is not limited to) piece rate payments.
-
The Platform may include features which prevent the Employer from posting a Listing in contravention of clause 8(d) and the Employer must not make any attempt to circumvent or override those features in the Listing.
-
The Employee is responsible for making its own inquiries as to the suitability of the Job for the Employee, and for proper performance of the Job, at the times and locations required, to a professional standard.
-
The Employee should know their rights and monitor the Employer’s compliance with the Employment Laws, including familiarising itself with the Tips for Staying Safe in the Jobs Category for Job Seekers.
-
If a Listing offers Goods for sale, this clause 9 applies to those Goods.
-
If a Listing for Goods is for a Vehicle, also see clause 10.
-
If a Listing for Goods is for a Pet, also see clause 11.
Seller Responsibilities
-
The Seller represents and warrants that:
-
they are the sole beneficial owner of the Goods, with title lawfully obtained, free from any security interests, finance, or other encumbrances; and
-
any defects (including minor defects) are clearly and accurately stated in the description of the Goods and are not otherwise disguised or overlooked in the Listing.
-
-
The Seller must keep detailed evidence of the condition of the Goods at the Seller’s last point of contact with the Goods prior to Exchange. This includes descriptions and photos of any existing wear and tear or damage that has been disclosed to the Buyer prior to Exchange.
-
The Seller acknowledges and agrees that Buyers have rights under the Consumer Laws, which to the extent applicable to the Seller and Buyer, apply to second-hand goods to the extent reasonable with regard to the age, description and price of such Goods. This includes that the Goods are of acceptable quality, will match its description and be fit for purpose. The Seller must have regard to these guarantees when describing the quality, condition, and functionality, and setting the price, of the Goods and must not attempt to exclude, restrict or modify any guarantees that are applicable under the Consumer Laws.
Buyer Responsibilities
-
The Buyer acknowledges that Goods may be second hand if described as such, and the Buyer is responsible for reading the description of the Goods and satisfying itself that the Goods as described will meet the Buyer’s requirements prior to agreeing to Exchange, including with regard to its age, description and price.
-
For all Exchanges, the Buyer warrants that it has satisfied itself with the condition of the Goods (whether by inspection or otherwise) prior to making payment.
-
If Exchange will occur in person, Buyers are encouraged to ensure their safety by:
-
verifying the identity of the Seller prior to meeting in person;
-
selecting a public place to meet, during daylight hours; and
-
never allowing anyone to enter your home.
-
-
If Exchange will occur via courier or delivery, the Seller and Buyer must agree to delivery costs (if any) prior to Exchange. The Seller must use a courier or registered post and provide the Buyer with a tracking number.
-
Gumtree strongly encourages Buyers to be cautious when giving their address to Sellers and use secure, third-party technology to arrange delivery of Goods.
-
Title to the Goods will pass to the Buyer on payment of the Exchange Fee. Risk of loss or damage to the Goods will pass to the Buyer on delivery.
-
The Seller must use registered post or a reputable third party courier service. If there are any issues during delivery, the Buyer must promptly report the issue to the Seller.
-
If the delivery issue cannot be resolved, and the Seller cannot provide evidence that the Goods were shipped, the Seller must refund the Buyer the amount paid to the Seller for the Goods including shipping.
-
If the Seller can provide evidence that the Goods were shipped, the Seller must take all steps necessary to ensure the third party courier delivers the Goods or refunds the amount lost to the Buyer.
-
If the Seller can evidence that the Goods were delivered, the Goods will be deemed delivered.
-
Claims for loss of or damage to Products in transit must be made against the courier by the Seller. Gumtree accepts no liability for any loss or damage to any Goods during delivery.
-
The Buyer acknowledges and agrees that Gumtree is not a party to any agreement between you and a Seller and does not owe the Buyer a refund for any purchase made through the Platform.
10. SPECIFIC TERMS FOR VEHICLES
-
If a Listing offers a Vehicle for sale, in addition to clause 9, this clause 10 applies and will prevail to the extent of any inconsistency with clause 9.
Dealers and Individuals Selling Vehicles
-
Buyers acknowledge and agree that Vehicles may be sold by Sellers who are:
-
individuals, in which case the Consumer Laws may not apply; and
-
dealers, where the Consumer Laws will apply – and the Seller must ensure that the Listing is fully compliant with the Consumer Laws and any other applicable laws relevant to auto trade dealership from time to time.
-
-
Despite clause 10(b)(A), regardless of whether a Seller of a Vehicle is an individual or a dealer, as a standard upheld by this Agreement, the Seller must ensure that the Listing is accurate, comprehensive and not misleading, including:
-
describing or showing in images any defects that may limit or otherwise effect the Vehicle’s fitness for purpose or factory functionality; and
-
not claiming that the Vehicle has any particular features or capacity that it does not have or no longer has.
-
-
However, Buyers who purchase Vehicles from Individuals acknowledge and agree that “buyer beware” applies and the Buyer must make all diligent inquiries a reasonable person would make to mitigate their risks and determine the health of the Vehicle and the accuracy of the Listing and Seller’s claims prior to Exchange.
Manufacturer’s Warranties and Roadworthiness
-
All Vehicles are sold without manufacturer’s warranty unless a manufacturer’s warranty is clearly stated to apply in the Listing.
-
A Vehicle may be sold without roadworthiness if expressly stated as such in the Listing. The Seller’s failure to state the lack of roadworthiness in a Listing will be a breach of clause 10(c).
Before Exchanging on a Vehicle – Risks for Buyers
-
Before agreeing to Exchange on any Vehicle, Gumtree strongly encourages all Buyers to:
-
obtain a third-party professional assessment of any Vehicle, at the Buyer’s cost. This is particularly important when purchasing a Vehicle from an individual for the reason provided in clause 10(b)(A);
-
check the registration database in the relevant jurisdiction and verify ownership of the Vehicle against identification of the Seller, and determine that there is no finance or other encumbrances on the Vehicle;
-
personally test drive any Vehicle and be wary of any Seller or Listing encouraging you to purchase a Vehicle without test driving that Vehicle regardless of the urgency or inconvenience of your circumstances.
-
-
If available in the state in which a Vehicle is located, Buyers may choose to utilise the services of our third party partner, Team Inspect Pty Ltd ABN 96 637 480 365, operating under the registered business name “Car Inspect” (Car Inspect). Car Inspect offers a mobile car inspection service by qualified mechanics. Gumtree provides an introductory service to connect Buyers of Vehicles with Car Inspect. However, Gumtree is in no way responsible or liable for the acts or omissions of Car Inspect, or any decision made in reliance on information provided by Car Inspect. Car Inspect may require you to agree to separate terms and conditions in order to use Car Inspect’s services, and all services performed by Car Inspect will be governed by those terms and conditions (without limiting the exclusion of Gumtree’s liability in this clause).
-
Buyers acknowledge the significant risks to personal safety in purchasing a Vehicle, including the various forms of road accidents caused or contributed to by disguised or unknown defects in a Vehicle, including the specific risk of permanent physical injury or disability, including burns, broken bones, paraplegia, quadriplegia, permanent vegetative state, or death. Gumtree’s liability is limited in accordance with clause 20.
-
After Exchange but prior to taking delivery of the Vehicle, Gumtree strongly encourages Buyers of Vehicles to purchase comprehensive insurance of a suitable value to cover all risk of damage, injury or death to yourself and third parties, and replacement of the Vehicle.
-
If a Listing offers a Pet for sale, in addition to clause 9, this clause 11 applies and will prevail to the extent of any inconsistency with clause 9.
-
If you sell a Pet, you are solely responsible for ensuring compliance with our Pets Policy and all applicable legislation and regulations in the jurisdiction in which you reside including the Animal Protection Laws and all applicable laws relating to breeding practices, micro-chipping, animal protection and welfare.
-
If you purchase a Pet, you are solely responsible for inspecting the Pet and ensuring that all relevant documentation is provided to you at the point of Exchange. Once you take possession of a Pet, you are solely responsible for providing for the welfare of the Pet, including all veterinary expenses. We strongly encourage all Pet owners to obtain Pet insurance.

Nothing in this Agreement is intended to limit the operation of the Consumer Laws. Under the Consumer Laws, you may be entitled to certain remedies (like a refund, replacement or repair) if there is a failure with any Goods or Services. Those rights may include:
-
for major faults, the right for the Buyer to elect a repair, replacement, re-performance or refund for major faults, or
-
for minor faults, the Seller’s obligation to offer at the Seller’s choosing one of those remedies.
-
-
Sellers are responsible for ensuring that any rights available to the Buyer under the Consumer Law are honoured by the Seller.
-
If you are a Buyer and you experience an issue with a Good or Service, you must direct all inquiries in the first instance to the Seller, providing a description of the issue and evidence including photos and videos where appropriate.
-
The Seller must respond reasonably to all such inquiries, relying on the evidence it retained on the condition of the Goods or Services as part of creating the Listing, and with regard to the rights available to the Buyer under the Consumer Law and this Agreement.
-
For any Goods that are sold via shipping, if a refund request cannot be resolved between the Users, the Buyer may submit a dispute to Gumtree, in the first instance, or to the third party payment provider where applicable. Upon receipt of a notice, Gumtree may, do any of the following:
-
require further evidence from both Users, including the description and photos given in the Listing or disclosed between the parties and the discussions between the Users – and such information must be provided as soon as reasonable practicable after receiving a request from Gumtree;
-
make a determination as to who is entitled to keep the Exchange Fee;
-
suspend the Seller’s Account or the Buyer’s Account (or both) until the issue is resolved;
-
decide on a fair split of the Exchange Fee between the Seller and Buyer; or
-
if payment was made via our third party payment provider, make any other determination available to it based on the policies and procedures of the third party payment provider.
-
-
If the Buyer paid the Exchange Fee through our third party payment provider, the provider’s refund policy and process may differ, and will apply. The Buyer may contact Gumtree in the first instance, and Gumtree may direct the Buyer to the third party payment provider to resolve the refund claim.
-
Return shipping costs are not included in any refund process and will be payable by the Buyer.
-
If a User is not satisfied with Gumtree’s or the third party payment provider’s (as applicable) resolution of the refund claim, the User must follow the disputes process in clause 19.
-
Before submitting a chargeback to the Buyer’s credit card company, the Buyer must first follow the process in this clause and attempt to determine a suitable outcome with the Seller.
-
If the Buyer submits a chargeback, the chargeback will be processed by our third party payment provider and their decision on the appropriate outcome will be final. Gumtree does not represent or warrant that any chargeback lodged by the Buyer will be successful.
-
In the event a chargeback is lodged, the Seller must promptly provide Gumtree with all information and evidence required to dispute such chargeback.
-
If:
-
the chargeback claim is successful, Gumtree will either:
-
deduct the chargeback amount from any funds held in the Seller’s Account, including deducting any such amount from any authorised payment method linked to the Seller’s Account (even if this results in placing the Seller’s Account into negative balance);
-
pursue the chargeback amount as a debt due and payable to Gumtree through any available legal process, including third party debt collectors at the Seller’s cost and/or appropriate courts; or
-
pursue any other means legally available to Gumtree, or
-
-
the chargeback claim is not successful, the chargeback will not be processed.
